General terms and conditions of sale

ARTICLE 1 - PURPOSE AND SCOPE

The purpose of these General Terms and Conditions of Sale (hereinafter referred to as "GTCS") is to define the terms and conditions applicable to the services provided on the www.lrc-bagagerie.fr website, in any capacity whatsoever, by LRC Logistique (France), a Société à Responsabilité Limité Unipersonnelle with capital of 15,000 euros, having its registered office at 735, Front de Saône, 69830 Saint Georges de Reneins, registered with the Villefranche sur Saône-Tarare Trade and Companies Register under number 921 957 007, hereinafter referred to as "LRC".

ARTICLE 2 - DEFINITIONS

The following definitions apply to the Conditions governing the contract of carriage and various services agreed with the Customer:

LRC Lugagerieor "LRC", "to us", "our" designate LRC Bagagerie, its auxiliaries, its operating partners, agents and subcontractors.

Customer, or "her", "his/hers" and "it" mean the customer, the sender, the consignor or the consignee of the Baggage shipment, the holder of the confirmation bearing the purchase code, or of a consignment note, or of an equivalent transport document, the consignee and the holder of the contents of the Baggage, any other party having legal ownership of the contract of carriage or any party having an interest in the performance of various services.

Luggage, means all of the Customer's "effects", objects or "articles" or "goods", which he/she prepares for strictly personal use for the occasional transfer from the place of departure and/or collection to the place of destination and/or delivery, contained in a suitcase, duly closed by means of a numerical combination, a snap hook, a padlock or an equivalent security system (preferably TSA - Transportation Security Administration - padlock for luggage bound for the United States of America).

Shipping, or "send", "journey" means the order that the Customer makes from one place (departure) to another (arrival) for personal or professional reasons by air, sea or land carrier. Includes all baggage delivered on the same order.

Confirmation of purchaseThis is the communication that the Customer will receive, by sms or e-mail, at the end of the transport purchase procedure, containing the alphanumeric or simply numeric code of the Shipment and the link (URL address) to the web page reserved for the Customer, where the transport data will be summarised: sender, recipient, collection day, delivery day, collection address, delivery address, e-mail address and telephone numbers for communications relating to collection and delivery, number and weight of items of luggage, cost of service, payment details; implemented by us for operational purposes..

Unforeseeable eventmeans the event which causes non-performance, or a delay in performance due to the impossibility of performance arising from a cause not attributable to the party.

Force majeuremeans extraordinary or unforeseeable events: for example, riots, wars, acts of terrorism and any other cause, provided that in each case, whether expressly provided for or not, such cause could not have been avoided by taking all measures to prevent the damage.

DamageDamage to Baggage means the total or partial deterioration, failure or breakage of Baggage, attributable to extraordinary events occurring during carriage and other than normal wear and tear resulting from transfer activities, which may be the subject of repair, restoration or compensation.

Lossmeans the total loss of baggage.

Prohibited items and Items not accepted means any items the carriage of which is prohibited by the laws, rules or regulations of any country through or over which the shipment travels, or by these Conditions.

Debt collectionrefers to the complaints procedure.

EUrefers to the European Union.

Extra - EUindicates non-EU countries.

UNITED STATESrefers to the United States of America.

ARTICLE 3 - The supplier company

The contract for the transport of luggage and other services is concluded with LRC Logistique or with the auxiliary, affiliated or operating partner, sub-transporter or supplier of LRC Bagagerie who accepts the Customer's shipment for transport or the performance of various services.

The Customer acknowledges and accepts the right of LRC Bagagerie to entrust all or part of the transport to sub-transporters, partners and/or auxiliaries under the conditions set by them. In the event that all or part of the service is delegated to third parties, the Customer acknowledges the validity of the Conditions established by the sub-transporter, partner operator and/or auxiliary service provider.

ARTICLE 4 - Terms and conditions

By subscribing to the service and transferring the transport, the Customer accepts these Conditions, as well as the data contained in the "confirmation of purchase", in the consignment note and/or in the transport contract and/or in the contract for the performance of various services, on behalf of the Customer and/or on behalf of any other person having an interest in the shipment or for the performance of various services, whether or not the Customer has signed the transport document and/or the consignment note.

The Conditions also refer to those whose assistance we use or to whom we entrust the service for the collection, transport or delivery of the shipment or for the performance of various services; they also refer to our employees, directors and agents. Only an authorised officer of ours, with full powers, may agree to changes in these Conditions in writing.

If the Customer entrusts the shipment to us with oral or written instructions which are contrary to or in any way incompatible with our Conditions, and which have not been expressly authorised by us and approved in writing, we shall not be bound by such instructions.

ARTICLE 5 - Purpose of the contract

The purpose of the contract is to transport the Customer's luggage from the place indicated for collection to the place indicated for delivery under the conditions set out in these Conditions and in compliance with the instructions given by the Customer in the order and/or in the transport request completed via our website, our teams or our call centre.

ARTICLE 6 - Baggage size and weight limits

Luggage is unique and any appendage attached or linked to it will not be considered as a suitcase but as a container for the personal effects it contains.

The weight and size limits applicable to individual baggage items shipped with the LRC Bagagerie Service are as follows:

  • Maximum actual weight: 70 kg

  • Maximum dimensions: 300 x 200 x 160 cm

The volumetric weight corresponds to the conversion of the volume of a parcel into a weight in order to determine the space it occupies.

The volumetric weight is calculated as follows: W x H x D/5000

It is compared with the actual weight, and the higher weight is used for billing.

All baggage will be weighed and measured using overhead scanners, which will give an irrefutable answer.

In the event that the weight verification and control system detects that the actual weight of the baggage is different from that declared by the Customer at the time of purchase, or that it is non-transportable under these Conditions (in terms of weight and dimensions).

In the event of a discrepancy, we will invoice you a flat-rate amount of 30 € per item, plus the additional cost of the incorrect declaration, corresponding to the rate actually due.. Given the growth in national and international traffic volumes, temporary surcharges may be introduced at any time without LRC Bagagerie being able to intervene in these additional charges.

In any event, exceeding the maximum authorised weight or dimensions will result in the cancellation of the refund guarantees provided for in these conditions.

ARTICLE 7 - Prohibited and dangerous items - Safety

  1. DANGEROUS GOODS

LRC Baggage does not carry or provide any other services in relation to baggage which, at our sole discretion, contains items which are dangerous and/or deemed to be dangerous, including but not limited to those specified in the International Civil Aviation Organisation (ICAO) Technical Instructions, the International Air Transport Association (IATA) Dangerous Goods Regulations, the International Maritime Dangerous Goods Code (IMDG), the European Agreement concerning the International Carriage of Dangerous Goods by Road (ADR), or any other national, EU or international legislation applicable to the carriage and carriage of dangerous goods, in the International Maritime Dangerous Goods Code (IMGD), in the European Agreement concerning the International Carriage of Dangerous Goods by Road (ADR), or in any other national, Community or international legislation applicable to the carriage and performance of various services relating to dangerous goods.

  1. AVIATION SAFETY REGULATIONS

The Customer, by agreeing to the Service and entrusting us with the delivery of the Baggage, ensures that it does not contain any Prohibited Items. Consignments transported by us or managed by us may be subject to security checks, including the use of X-ray and/or scanning systems and the Customer agrees that the bag may be opened and its contents monitored during transit.

The Customer therefore authorises LRC Bagagerie and/or the auxiliaries, associates and affiliates of LRC Logistique SARL operational partners, agents and independent service providers of LRC Bagagerie the customs or police authorities to carry out any necessary security on the baggage that will be transported by air.

The Customer guarantees that he has placed the luggage to be transported, or for the performance of various services, in secure locations and guarantees that the consignment has been protected from any unauthorised or illegal interference during its preparation, packaging and transport, up to the time before acceptance of the luggage by LRC Bagagerie.

  1. ITEMS PROHIBITED OR NOT ACCEPTED BY LRC BAGAGERIE

LRC Bagagerie does not carry luggage containing the following items:

  • Sprays;

  • Vehicle fuel system components that have contained fuel;

  • Alarm devices;

  • Explosives, including detonators, fuses, mines, grenades, fireworks and pyrotechnics;

  • Gas, including propane and butane;

  • Flammable liquids, including petrol and methanol;

  • Coolant and irritant liquid;

  • Radioactive materials, including medicinal or commercial isotopes;

  • Flammable solids and reactive substances, including magnesium, ignition devices;

  • Corrosive substances, including mercury and vehicle batteries;

  • Perfumes, flammable liquids/solids, including alcohols above 70 degrees

  • Magnetising material;

  • Oxidising substances and organic peroxides, including bleach and bodywork repair;

  • Toxic or infectious substances, including rat poison and infected blood;

  • Underwater torch with batteries included;

  • Plants, seeds and animals, living or dead;

  • Negotiable securities and certificates (bills of lading);

  • Currency (cash, coins, credit cards, prepaid cards and traveller's cheques)

  • Other non-marketable securities

  • Material that could be defined as pornographic or obscene ;

  • Weapons equipment, ammunition, bullets, firearms and weapons;

  • Software, video games and hardware components;

  • Waste;

  • Political material

  • Hazardous materials;

  • Perishable products;

  • Pharmaceutical products in quantities exceeding the customer's personal 30-day therapy;

  • Narcotics and psychotropic substances;

  • Tobacco, alcohol and tobacco products;

  • Works of art;

  • Antiques ;

  • Antiques Cultural heritage in general Metals (gold and silver in all forms) and precious stones;

  • Metals (gold and silver in all forms) and precious stones;

  • Documents, offers to participate in public or private tenders, security papers, meal and fuel vouchers, etc. ;

  • Fragile objects, such as glass, bottles, etc. ;

  • Architectural models;

  • Goods subject to customs duties;

  • Biological tissues and anatomical parts;

  • Watches

  • Ivory and ivory objects;

  • Animal skins and furs;

  • Computers, photographic equipment, camcorders, mobile phones, tablets, consoles, video games, electrical and electronic equipment

The Customer acknowledges and accepts that the carriage of such objects, even if they are not visible to X-rays and/or scanners, contained in the luggage, is absolutely prohibited and, in any event, not accepted by us, as well as being subject to the particular conditions and regulations of the sector which in certain cases and in certain countries provide for financial penalties, arrest and/or imprisonment of the manager/holder/owner/owner.

In the event of the insertion of the items listed above inside the baggage, the Customer will be solely and exclusively responsible for any civil and criminal consequences arising from the simple transport of the baggage, and, to this end, indemnifies LRC Bagagerie, the sub-transporters, associates and auxiliaries from any administrative, pecuniary, civil and criminal liability in this respect. LRC Bagagerie considers the list of items mentioned above, with the exception of those prohibited by international, national and American regulations, which are not exhaustive for customers from the United States with a direct departure from a Member State of the United States and a direct destination to a Member State of the United States.

The Customer is informed that, due to the inadequate preparation of baggage and/or the insertion of prohibited and/or non-accepted items, the baggage itself, as well as its contents, could be destroyed.

ARTICLE 8 - Possibility of inspection

The Customer acknowledges and accepts that LRC Bagagerie or government authorities, including customs, and their delegates have the right to open and inspect baggage for security reasons. The Customer is informed that baggage to and from the United States will be inspected by the Transportation Security Administration (TSA).

In the event of suspicion, the TSA will forcibly open the bag to check its contents. LRC Bagagerie informs the Customer that there are TSA type padlocks on the market that can be opened by the TSA with a specific master key held by the TSA.

ARTICLE 9 - Luggage preparation, collection and delivery times and procedures

Baggage will be collected from Monday to Friday on working days (excluding national and local public holidays), between 9.00 am and 7.00 pm on the day specified, at the address indicated in the Purchase Confirmation.

Baggage will be delivered from Monday to Friday on working days (excluding national and local public holidays), between 9.00 a.m. and 7.00 p.m. on the agreed day, to the address indicated in the Purchase Confirmation. Delays caused by customs, public administration or other events beyond our control may affect collection and delivery times.

Collection and delivery dates for small islands and/or remote locations may be subject to change, even significant change, and are subject to the operations of sub-agents and other circumstances (e.g. weather conditions, availability and operation of ferries and personnel involved, arrangements by local and/or national authorities, etc.).

Collection will be carried out by staff designated by LRC Bagagerie or by DHL. The baggage, provided with an identification label containing personal data (surname, first name and address) as supplied in your confirmation e-mail, must be packed over its entire surface, leaving the fixed handle and wheels free, at the customer's expense and care with transparent film. The film must be applied in such a way that the identification label is easy to read.

LRC Bagagerie, DHL or another person in charge of shipment may deliver the Baggage to the address indicated on the label directly to the Customer or to any person who appears legitimate to accept delivery on behalf of the Customer (for example, persons residing in the same building as the beneficiary or neighbours). For information on Baggage transport, the Customer may consult the www.lrc-bagagerie.fr website by entering the code shown on the Purchase Confirmation, or contact our call centre.

Our partner DHL's ODD option enables customers to track the progress of their parcel using the 10-digit tracking number provided when the order is confirmed, and offers re-delivery options if required.

On the day of delivery, the customer is notified by e-mail and text message that the parcel will be delivered shortly. In the event of absence, the customer can choose a re-delivery free of charge from the following options: a new postal address or DHL relay point, a new secure drop-off location or a new recipient.

ARTICLE 10 - Customs

Any customs duties, taxes, penalties, storage charges or other charges which we incur or may incur as a result of customs or governmental action or as a result of the Customer's and/or the consignee's failure to provide appropriate documentation and/or to obtain licences or permits, the Customer or the consignee (if different from the Customer) of the shipment will be invoiced. If we decide to invoice the consignee (if different from the Customer) and the consignee refuses payment of the amount, the Customer undertakes to pay that amount together with any sums owed by us or by us to third parties and any additional costs we incur.

At our request, the Customer undertakes to provide appropriate security for each of the duties, taxes, penalties, condition of the premises or any other expense provided for in this article. The Customer is always responsible for what he has put in the luggage and LRC Baggage will not be responsible for any delay, loss or damage caused by the intervention of customs personnel or other government authorities, or the presence in the luggage of items prohibited under this contract, national and supranational rules that regulate security and / or the entry of things in the country of transit and / or destination.

The Customer is aware that, due to inadequate preparation of baggage and/or the insertion of prohibited and/or non-accepted items, the baggage itself, as well as its contents, could be destroyed by customs personnel or other government authorities.

ARTICLE 11 - Incorrect address

If we are unable to deliver your Baggage due to an incorrect address, we will use reasonable endeavours to find the correct address.

We will inform the customer of the correction and delivery or attempted delivery of the consignment to the correct address, in which case additional charges may apply if the correct address is different to that shown on the consignment note or transport document. LRC Bagagerie does not deliver to P.O. Boxes.

If we are unable to deliver on the first attempt, the Customer now acknowledges the right to leave a notice of the shipment at its destination, such notice being sufficient proof of attempted delivery. LRC Bagagerie, at no extra cost, guarantees two further delivery attempts within two working days.

If delivery to the destination is not possible after the baggage has been collected, the Customer will be charged €10.00, it being understood that the Customer's request for a change is subject to its operational feasibility.

ARTICLE 12 - Shipments of undeliverable and rejected baggage

If we are unable to complete delivery of the baggage, we will, if possible, leave a calling card at the recipient's address, indicating that an attempt has been made to make delivery.

If the Customer does not provide appropriate instructions (as described in article 9) after our delivery attempts, or in the case of refused shipments, the luggage will be returned to the sender: the cost of the return shipment will be debited from the credit card indicated by the Customer at the time of purchase.

ARTICLE 13 - Customer obligations

The Customer guarantees and assures LRC Bagagerie that :

  1. Luggage (including, but not limited to, weight, size, number and type) has been accurately described at the time of purchase.

  2. Baggage has been stripped of labels, tags or stickers from previous journeys or expeditions.

  3. Has affixed to the baggage a dispatch note provided by LRC Bagagerie when confirming the order, containing (surname, first name, delivery address, telephone number) as well as the bar code scanned by the carrier.

  4. The place indicated for collection and delivery will be occupied from 9.00 a.m. to 7.00 p.m. on the days indicated.

  5. The collection and delivery information (e.g. contact person, house number, entrance, porter, intercom, name, etc.) that you have provided is accurate, complete and true;

  6. The person responsible for delivering and collecting the baggage has been duly delegated or authorised by you.

  7. The transport label has been affixed to the baggage securely and in a visible place on the external surface of the baggage; that the information contained in the label (address and name) is accurate and conforms to that indicated in the Purchase Confirmation;

  8. Wrapped the entire surface of the bag, leaving only the fixed handle free, in transparent film so that the identification label could be read.

  9. Checked the application of the tape on the single bag, if necessary;

  10. The contents of the baggage have been prepared, stowed, ordered, closed and sealed in a safe and accurate manner, so as to be protected against transport risks, including the associated handling and/or sorting processes.

  11. Declared the correct weight/size of luggage

  12. The effects, goods and objects contained in the baggage are of a strictly personal nature, are not subject to BEX, IATA or ICAO restrictions and are not prohibited and dangerous articles within the meaning of article 6 (prohibited and dangerous articles - safety) of these Conditions; in any case, for safety reasons, the Customer may never put food or liquids of any kind in the baggage;

  13. Neither the Customer nor the recipient is a person or organisation with whom LRC Bagagerie cannot have commercial relations under the applicable laws or regulations.

  14. All applicable laws and regulations have been complied with, in addition to the provisions of this contract.

  15. Have taken all reasonable precautions required by conventions, directives and laws relating to the protection of personal data in order to ensure the protection of such data in the event of failure or incorrect delivery of the shipment.

  16. That you have locked the baggage and each of its pockets and/or external openings with a padlock (mandatory TSA type for baggage destined for the USA) or with another security system that prevents it from being opened.

You agree to indemnify and hold us harmless from and against any liability, costs, damages or expenses, including legal fees, that we may incur against you or any third party as a result of your breach of any of these warranties, obligations and assurances.

ARTICLE 14 - Limits of liability

Without prejudice to the provisions of art. 14, the liability of LRC Bagagerie, in the event of loss, theft and robbery, whether total or partial, damage or delay, occurring in the shipment of baggage or in the event of non-execution of the service, will be limited as follows:

  • Delay : Delivery made after 48 working hours following the day indicated in the purchase confirmation or, in the event of a discrepancy, on the dispatch note, is considered to be "late". In the event of a delay, LRC Bagagerie will give the Customer a Voucher valid for one year for a shipment of equivalent value;

  • Non-performance of the service In the event of non-recovery and/or delivery of luggage for reasons attributable to LRC Bagagerie, LRC Bagagerie will refund the Customer the amount paid for the service not provided. In the event of total or partial loss, theft and robbery, if the Customer has been compensated for any reason whatsoever by third parties, no claim will be accepted by LRC Bagagerie with the exception of the part that may exceed the reimbursement received and up to the amount of the amounts indicated above .

LRC Bagagerie may stipulate with certain categories of Customers, Companies or Associations, particular conditions of liability by means of specific Agreements or Conventions. The said Agreements or Conventions may never derogate from the general principles of the Conditions concerning the liability of LRC Bagagerie in accordance with Articles 12 (Obligations of the Customer), 13 (Limits of Liability), 14 (Exclusions of Liability) and 15 (Valuable Goods).

ARTICLE 15 - Disclaimer

Except in the cases provided for in Article 13 above, given that it is possible to send luggage in advance, we shall never be liable to you for any pecuniary or non-pecuniary damage arising from the missed, incorrect and/or delayed delivery of luggage. We shall not be liable to you for any loss or damage, whether pecuniary or non-pecuniary, arising out of the missed, incorrect and/or delayed delivery of Baggage, and thus (by way of example but not exhaustively), for missed, delayed or partial participation in events, exhibitions, conventions, congresses, conferences, examinations, courses, refresher courses, shows, radio, video and television broadcasts, ceremonies, banquets, celebrations, training sessions, competitions, tournaments, championships, tours, audio and video recordings, surgeries, medical examinations, loss of goodwill, revenue, profit, market, reputation, goodwill, use, opportunity, even if we have been advised that such damage or loss may occur, nor for any indirect, incidental, special or consequential damage or loss, including, without limitation, in cases of contractual termination, negligence, wilful misconduct or default.

LRC Bagagerie will not be responsible for the obligations assumed with the Customer for the following facts and/or events:

  1. Circumstances beyond our control such as (but not limited to): acts of God, including earthquake, cyclone, storm, flood, fire, disease, fog, snow or frost; an event of force majeure, including (but not limited to) war, accident, act of terrorism, strike, embargo, airspace hazard, local dispute or civil commotion; national or local disruption to air or land transport networks and mechanical problems with modes of transport or machinery; hidden or intrinsic defects in the contents of the baggage; criminal acts committed by third parties such as theft, burglary and arson.

  2. Acts or omissions attributable to the customer or to third parties in respect of the work for which you are responsible for the obligations assumed under the Conditions and in particular the guarantees provided for in art. 11; and similarly for acts or omissions attributable to: local and customs authorities, airlines, airports or public officials.

  3. Contents of the Baggage consisting of items which are goods prohibited by law or by this contract, even if we have accepted carriage in error. The only liabilities attributable to us in connection with the services rendered shall be those governed by these Conditions.

  4. He has not wrapped the entire surface of the Baggage, leaving only the fixed handle free, with a transparent film such as a domo pack or equivalent. e) for the delivery of the Baggage to another person who appears legitimate to take delivery on behalf of the Customer (for example, people living in the same building as the recipient or neighbours).

ARTICLE 16 - Valuable goods

In confirmation of the provisions of article 6.3 (Articles prohibited or not accepted by LRC Bagagerie), the Customer may not insert any objects, effects or valuables in the baggage entrusted to LRC Bagagerie, such as: precious stones, precious metals, jewellery, money, valuables, instruments of trade, glass or porcelain, works of art, antiques, cultural property and important documents, including (but not limited to) passports, offers to participate in public or private tenders, shares and option certificates, securities, bank documents, guarantees or sureties.

If the Customer has placed objects or valuables in their baggage, these will be transported at their own risk.

ARTICLE 17 - Third-party claims

The Customer undertakes not to allow any other person with an interest in the shipment to make any claim or bring any action against us in connection with the shipment, even if we have been negligent. Failing this, and in the event of a claim or action, the Customer will indemnify us against the consequences of the claim or action and the costs and expenses we incur in protecting ourselves.

ARTICLE 18 - Claim recovery

The Customer who intends to make a claim for the shipment of lost, damaged or delayed Baggage, or for any other damage, must comply with the provisions of the applicable national legislation or international conventions, by observing the following procedure. Otherwise, we reserve the right to reject the claim. In particular, the Customer must make written notification in :

  • 7 calendar days from receipt of baggage in the event of damage, theft or partial theft;

  • 7 calendar days from the date on which the Customer or the recipient (if different from the Customer) should reasonably have been aware of the loss, damage or delay of the Baggage.

After the first report, and at the latest within the limitation period provided for by applicable law or agreements, the Customer must document the claim by providing us with all relevant information relating to the shipment and the loss, damage or delay suffered. We shall not be obliged to act on any claim until the consideration for the carriage and ancillary services due to us has been paid, and the Customer shall not be entitled to deduct the amount of the claim from the freight and ancillary services due. Unless otherwise provided by applicable conventions and/or laws, the Customer's right to bring an action for damages against us shall expire within 1 (one) year from the date on which the Customer could reasonably have become aware of the loss, damage or delay, unless the action is brought before the competent judicial authority.

In the event that we accept all or part of the claim, the Customer warrants that its insurance or third parties with an interest in the shipment waive any right, remedy or claim to which they may be entitled by virtue of subrogation or otherwise. .

Reimbursement will be made only and exclusively on presentation of the following supporting documents: transport ticket; purchase code; list of personal effects contained in the baggage and proof of their value; copy of the complaint. LRC Bagagerie, after having examined the documentation of the accident and having judged it to be complete for the purposes of the definition, will inform you of the terms and conditions and the amount of the settlement.

ARTICLE 19 - Rates and payment

- The Customer undertakes to pay us the price (freight) for the carriage of the Baggage between the places specified on the consignment note, the contract of carriage, and/or the costs of carrying out ancillary services, transport value-added taxes and any other charges, taxes, costs or fees within the agreed payment period, or immediately after the purchase of the shipment on our website or via our call centre. Our charges are calculated on the basis of the rates applicable to the shipment, as illustrated in this contract and in our price lists.

- LRC Bagagerie will verify the size, weight and/or volume and/or number of bags and, in the event of a discrepancy between the declared size and/or weight and/or volume and/or number of bags, the Customer agrees that the size, weight and/or volume and/or number of bags determined by us will be used for the purposes of calculating the difference in rate to be charged to the credit card used for the Purchase. Any taxes and other levies on the shipment to the country of destination must be paid to us by the Customer by debiting the credit card used for the Purchase.

Current shipping rates are available both on our website www.lrc-bagagerie.fr and from our call centre.

- The rates in force refer to the ordinary service of collection and delivery of luggage between the addresses indicated by the Customer. LRC Bagagerie reserves the right to charge an additional amount where the time required to complete customs clearance formalities requires excessive work to enable us to deliver the baggage to the recipient. Additional amounts may therefore be charged in certain countries for complex customs clearance activities and these include, but are not limited to, shipments that require:

  1. Formal customs entry declarations involving several items of baggage belonging to the same Customer.

  2. Customs restrictions or the need to deliver baggage containing items placed under customs control.

  3. Customs clearance involving a government department in addition to the customs authority.

In some countries, LRC Bagagerie may advance payment for charges, fees, taxes and penalties and, where this additional service is provided, the customer will be charged a local administration fee on the credit card used for the purchase.

Any Customer who, despite the size prohibition provided for in article 5 of these Conditions, has in any case dispatched oversized baggage, which exceeds the maximum length of 200 cm or the size limit of 300 cm (given by: perimeter + side length), will be charged a fee of 100.00 euros (cent/00).

  • Our invoice is issued in an unalterable electronic format (PDF or other equivalent format) and sent to the email address indicated by the Customer. Our invoice may be printed on paper and sent by ordinary post to the address indicated by the Customer. If the invoice is printed on paper and sent by post, the additional printing and postage costs will be charged to the invoice.

  • Our invoices must be paid in the currency indicated on the invoice (generally the Euro). Expenses and costs incurred by us for customs clearance, taxes, duties and any other sum requested and paid by us for the delivery of the baggage to the destination address will be charged to the Customer in the currency indicated on the invoice, converted into local currency. The Customer authorises LRC Bagagerie to request the debit of the aforementioned subsequent charges to the same credit card used by the Customer for the Purchase.

ARTICLE 20 - Right of withdrawal

Given the nature and type of Services offered by LRC Bagagerie, the Customer is aware and informed that the right of withdrawal provided for in Article 64 of the Legislative Decree does not apply to the Contract. 206/2005.

Before collecting the luggage, the Customer has the right to withdraw from the purchase of the Services against payment of a contractual penalty equal to 15% (fifteen per cent) of the sum paid to LRC Bagagerie at the time of purchase.

ARTICLE 21 - Jurisdiction

These conditions and any act or contract to which they apply are governed by French law and any dispute arising out of an act or contract to which these conditions apply shall be subject to the exclusive jurisdiction of the French courts.
